Decisions of the Secretariat meeting held on 08.08.2008.

 

            The CHQ.Secretariat of the Federation met on 08.08.2008.  There were eight issues slated for discussion at the meeting.  Prior to the meeting of the Secretariat, the Central JCA had met to evaluate the outcome of the discussions the representatives of the two Federations had with the Chairman on 07.08.2008.  Given hereunder are the decisions agenda-wise taken at the meeting of the Secretariat.

 

Item No. 1 & 2: Out come of the discussion with Chairman,CBDT on 7.8.08 and

                          Central JCA meeting reporting.

Kindly see the JCA circular enclosed.  It could be seen there-from that the ITGOA has agreed to participate in the one day strike slated for 20.8.2008.  All the Circle Secretaries are requested to kindly keep in touch with the State leaders of the ITGOA and immediately submit a letter to the respective CCsIT(CCA) intimating the decision of the Central JCA to organize the strike action on 20.8.2008.

 

It may kindly be noted that Central JCA has decided to revive the programme of agitation which was suspended in December, 2007 on the basis of an assurances held out by the Chairman CBDT.  The Secretariat has regretfully noted that no settlement has been brought about even on a single item which was subject matter of discussion with the Chairman on a series of formal and informal meetings that have taken place from November, 2007 to 07.08.2008.  Even on 7.08.2008 no indication has been made by the Board on its willingness to revise the instruction on the utilization of infrastructure fund, a major chunk of which, as you are aware, has been appropriated for the benefit of the Officers of the Department.  The Secretariat has also decided to reiterate its resolve to oppose every  attempt on the part  of the authorities to outsource the Data Entry work of the returns.  The Secretariat noted that the back log of the work was due to the fact that the DG (Systems) could not bring about an appropriate software programme to process the return in time. 

 

Item No.3.Organisational issue-Vidharbha Gr.C. Circle.

The Sect. approved the proposal to set up an adhoc committee with Com. Manik Waghmore as convenor and 6 other members.  They would be directed to function as Secretariat of the ITEF, Vidharbha Circle, Group C. till 30.11.2008 and complete the democratic process of elections and constitute a validly elected secretariat by that date.

 

Item No. 4. The impending Strike action slated for 20.8.2008.

In order to mobilize the members of the ITEF and to ensure cent percent participation in the one day strike action on 20.8.2008, the Sect. decided to deploy the following comrades to various places and request the concerned Circles to organize Br. Secretaries meeting and General meeting at the State Capitals on 12^th,13^th and 14^th August, 2008.

Item No. 5 & 6. The development in common issues & Action Programme.

It was reported that the Committee Of Secretaries has not yet submitted their report to the Government on the VI-CPC report.  It was informed by the Secretary General that the Confederation might embark  upon prolonged agitational programe including strike if no satisfactory settlement is brought about on the issues raised by the staff-side of the JCM before the Government in their meeting on 17.05.2008.  This includes raising minimum wage, rate of increment, change in the fitment formula and certain other issues like pension etc.

 

Item No. 7. Federation CHQ. functioning – finance etc.

The urgent necessity of Secretarial assistance at the CHQ. in view of the impending All India Conference was discussed at length.  The possibility of getting Foreign Service facility for Com. K.P.Raj Gopal was also explored.  It was finally decided that Com. K.P.Raj Gopal will come over to CHQ. in November, 2008.  Com. Amitav Dey and Com. Rupak Sarkar will be at the CHQ. on rotation, to attend to the day to day functioning from Sept. 2008.

 

Item No.8: Any other matter.

Com. Barun Goshal stated that in the Internal Audit wing, personnel from the ranges were being deployed resulting in acute shortage of man power in the field offices.  He was of the opinion that we should demand additional staff for the newly created posts of CsIT (Audit).  The Secretary General informed the house that the issue had been subjected to discussion with the Board.  It has been informed by the Board that the personnel had been drawn to the Audit wing by abolishing the functions of the Tax Recovery Offices.

 

Com. Rupak Sarkar brought to the notice of the house that in the last Chief Comissioners conference a proposal had been mooted to elicit the services of retired personnel to make up the shortage of staff.  The meeting decided that the Federation should oppose any such attempt on the part of the Board as it amounts to outsourcing of the Departmental functions.

Dear Comrade,

 

            The Central JCA met on 08.08.08 and reviewed the outcome of the discussion, the Federations Representatives had with the Chairman, CBDT on 7^th instant.  Exceoting  holding out assurances, as before, not a single issue has been finally clinched.  It was stated by the Chairman that the promotions to the cadre of ACs  for the recruitment year 2007-08 and 2008-09 would be made by 31^st August, 2008.  On the question of utilization of infrastructure fund, an issue on which the employees are agitated, no commitment was made by the Board to revise the present instructions.  The meeting came to the conclusion that the demands are to be now pursued through the course of a sustained agitational programe and decided:

 

a)      To convey to the Chairman the total disappointment over the course of negotiation and seek settlement of the issues by the end of August, through a resolution.

b)      To pursue the issues through a sustained agitational programe of action, which should commence from 4^th Sept. 2008 through a joint Lunch hour demonstration to popularize the demands to be followed by:

 

i)                    A massive Dharna on 10.9.2008 in front of all CCsIT Office.

ii)                   Half-day walkout on 17^th Sept, 2008 (post-lunch session)

iii)                 To commence the non-cooperation programe from 22.09.2008,which shall include stoppage of Survey and Submissions of Statistical reports etc.

iv)                 To review the action programe in the first week of October, 2008 to take appropriate decision.

 

The meeting also discussed the possibility of a joint strike action on 20^th August, 2008 as a measure of creating the joint movement and to project the 6^th CPC related issues amongst others.  After detailed deliberation it was decided that a joint Strike notice will be served on the CBDT and the ITGOA will advise its units to participate in the one day strike action slated for 20^th August, 2008.  The copy of the Joint Strike notice sent to the Chairman CBDT is enclosed.  All circles and Branches and units of the two Federations are requested to jointly submit a copy of the above stated notice to the concerned CCIT (CCA) with a covering letter duly signed by the Circle/State Secretaries of ITGOA/ITEF.  The notice is kept on the website of both the Federations and the Circle/State Secretaries are requested to download the same for appropriate action.

 

            The copy of the common Charter of demands and the resolutions adopted at the meeting (and submitted to the Chairman,CBDT) will be sent to the Circles/Branches by 25^th August, 2008.

                                    Sub; Departmental Examination 2008

            The Directorate has announced the schedule for departmental Examination 2008.  The Ministerial Examination commences on 19^th September, 2008 and ends on 24^th September, 2008.  The Inspectors and Income tax Officers Examinations will be from 25^th September, 2008 to 6^th October, 2008. The detailed schedule is as under:

            The Examinations are under the old syllabus and the eligibility condition is as decided in the last year examination. This is indicative of the fact that the candidates who had already availed ten chances and crossed the age limit of 55 may not be able to take up the examination this year also.  The Board had promised us last year that they would give this relaxation this year.  It seems that the assurance held out by the Board has not been conveyed to the Directorate.  We shall take this matter with the Chairman in the formal meeting scheduled to take place on 7^th August, 2008.  The concerned candidates may be informed accordingly.

            The Circle General Secretaries are requested to intimate the CHQ the probable number of candidates who would be able to take up the Examination if such relaxation is given in their charge.  This will help us to negotiate the issue fruitfully.

            The ITEF has served the notice for the strike on 20^th August, 2008.  Kindly see the write up.  You may utilize the same for the campaign programme.  Please ensure that proper intimation is given to all the CCITs (CCA) and to all the heads of offices by the Circles and Branches respectively. 

            The CHQ Secretariat is scheduled to meet on 8^th after noon preceded by the Central JCA meeting.  We shall convey you the decision of the two meeting by 10^th through the Website.

The message of 20^th August Strike.

On 20^th August, the Indian Working Class will organize yet another one day Strike action against the neo liberal economic policies pursued by the Indian ruling class, since 1991. The Strike is in the midst of an unprecedented inflation and price rise experienced by the Indian Economy second perhaps only to  the 1973 impact. The inability of the Govt. to contain the price rise is understandable for it is triggered by the phenomenal increase in the international market not only of crude oil but also of various other commodities. Due to the systematic efforts on the part of the successive Government that came to power since 1991, Indian economy stands presently integrated with the world market.  No effort on the part of the Govt. (whatever happening being insincere and cosmetic) will go to dent the upward rise of prices of the commodities of basic human consumption as the profit for the monopoly houses and TNCs is to be garnered from the poor people. 

It may be recalled that the stark rise of inflation in 1973-74 which touched about 20-25% led to the fall of Mrs. Indira Gandhi's Government which came to power with a 2/3^rd voting strength in the Parliament.  The second oil shock in 1979-80 which brought about 17% rise in the rate of inflation accentuated the downfall of the Janatha Government. We are steadily coasting towards that magic figure and to the same eventuality.

            The Prime Minister has been publicly advised by the media controlled by the monopoly houses and his own political and economic advisors that in the context of the double digit inflation, which has refused to come down or which cannot be brought down, the 6^th CPC recommendations are not to be implemented for it shall stock the inflationary fire further.  The realignment of political forces behind the Indian National Congress and the success it tasted in winning a confidence vote through all sorts of nefarious machinations will embolden the Government to push through the infamous pension reform bill in the coming session of the Parliament. The financial sector reforms which could not be carried out in the last four years due to the principled stand of  the left parties both inside and outside Parliament will now be brought for the consideration of the Parliament.  That was the open statement of the Finance Minister.

 

            The Indian National Congress which could not muster sufficient number of members in the Parliament to become the ruling party in the last election had to seek and obtain the support of the left parties on a solemn assurance that it will carry out the governance of the country on an agreed common minimum programme.    However, that Party, in whose name the Indian people fought the glorious battle for independence from the British imperialism, had no qualms to ditch the left parties for the sake of signing an agreement with the US imperialism for both political and economic subjugation of the country in the name of the nuclear deal is the irony of today. The 20^th August strike assumes significance and importance in that context.  It is not only therefore yet another action on the part of the working class against the IMF/World bank dictated economic policies of globalization and liberalization but should be construed as a revolutionary beginning for the real independence of our homeland.  That is the message we are to convey to jour rank and file of our members while campaigning for the 20^th August Strike.

 The demands adopted by National convention of Central and State Government employees and University, college and School teachers on 8th July, 2008

 

1. Accept the modifications suggested by the Staff Side JCM in the Standing Committee meeting held on 7^th May, 2008 and implement the 6^th CPC recommendations accordingly.
2. Afford right to strike to Government employees
3. Withdraw the new contributory Pension scheme and extend the existing defined benefit pension scheme to all Govt. employees including those recruited after 1.1.2004.
4. Stop privatization, corporatisation and downsizing of Government department and abandon the neo-liberal economic policies.

 

The Demands adopted in National Convention of Trade Unions on 13 May 2008

1. Take urgent step to contain price-rise through (a) universalizing the public distribution system throughout the country to cater all essential commodities at controlled price through PDS, (b) ban on futures and forward trading in all essential commodities, (C) reduction of tax in petrol and diesel, (d) stringent action against hoarding and black marketing.
2. Strict implementation of all labour laws particularly in respect of minimum wages, working hours, social security and safety and stringent action against all cases of violations; stop contractorisation and outsourcing
3. Scope of the Unorganized Sector Workers Social Security Bill pending in Parliament should be expanded to cover all unorganized sector workers irrespective of BPL or APL category to ensure a national minimum social security benefit for them as per unanimous recommendation of the National Commission for Enterprises in the Unorganized Sector (NCEUS) and the Parliamentary Standing Committee on Labour with Central Govt. Funding.
4. Farmers Loan Waiver Scheme to be extended to loans from private moneylenders; nationalized banks to extend easy credit to peasants at lower interest rate.
5. Lift ban on recruitment in Govt. services; remove the negative and discriminatory features in the recommendation of 6th Pay Commission and finalize the same for implementation in consultation with the employees organizations; expedite regularization and grant of pension to 'gramin dak-sevaks.'
6. Expedite wage negotiation for the employees of Central PSUs including the contract workers without any conditionality.

            We send herewith a copy of the letter addressed to the Cabinet Secretary dated 3^rd August, 2008, which would be submitted on 4^th August, 2008  This is the copy of the strike notice which the confederation would be serving on the Government on 4^th August, 2008 as per the decision taken at the National convention held at New Delhi on 8^th July, 2008. The charter of demands in pursuance of which we would be organizing the strike action is also enclosed to the above cited letter.  Kindly ensure that the similar strike notices are served on all Heads of Departments by the respective affiliated organizations.  The branches and units of the affiliates may kindly submit a copy of the respective strike notices with a covering letter to the Heads of offices for information and intimation.  Necessary instruction may kindly be issued in this regard to the branches. 

 

            As of writing this letter, we have no intimation of the Committee of Secretaries having finalized their report on the 6^th CPC recommendations.  We also do not know whether another round of discussions would be held with the staff side once the COS finalizes their views. However, there is strong pressure being exerted on the Govt. not to release the arrears to the employees as it might further intensify the inflationary impact on the economy.

 

            As has been indicated in our last circular letter, the National Executive will have an emergent meeting as and when the Government makes its view on the 6^th CPC recommendations known.

 

            Serious efforts may be undertaken to make the 20^th August 08 strike a grand success.
