Collection of donation from arrears.

We have intimated you (please see website) that the Government has issued the orders for the disbursement of arrears of salary (2nd instalment, 60%) vide orders dated 25th August, 2009. The arrears would be drawn and disbursed in September, 2009 in all offices. We take this opportunity to remind you of our decision to collect Rs. 100/- from each of our members out of the 6th CPC arrears. Very few Circles had collected this from the first instalment of arrears and remitted. We, therefore, request you to kindly ensure that the amount is collected and remitted to the ITEF CHQ @ Rs. 60/- per member, retaining the balance with the Circles. (Out of Rs. 60/, the ITEF CHQ will remit Rs. 20/- per member to the Confederation CHQ).The total remittance as on date on account of Renewal Fees from the Circles is Rs. 292019/-.  The Balance outstanding is Rs. 880687(including arrears). This shows the sorry state of affairs in so far as the remittance of renewal fees is concerned.  The renewal fees have been asked to be deducted from the salary of April, 2009 payable in May, 2009. Even after the lapse of four months, the collection has not been made over to the CHQ.  The Circle General Secretaries are requested to kindly look into the matter urgently.

Strike on 9th September,2009.(9.09.09)

As intimated to you the Central JCA has served the strike notice.In the meantime, the representatives of this Federation and the Associations in the CBEC were called for a meeting chaired by the JS(Per) Department of Expenditure to discuss the grade pay issue of Inspectors. No settlement has been brought about. Chairman, CBDT had been the Chief Guest on the annual day function of the ITEF Delhi Circle on 26th. Com. President and General Secretary, inter alia, had raised the issue of Departmental Examination with him. He has again directed them to meet the DG(Admn) for a dialogue and consequent settlement. The DG(Admn) was not available for a meeting on 26th. The Board has now intimated us that the Member (P) will take a meeting with the representatives of the two organizations (ITEF and ITGOA) on 31st inst. We shall intimate you of the outcome of the meeting after 31st. While these parleys might be going one, we request you to kindly mount the campaign programme amongst the mass of the employees to ensure that the strike action slated for 9th   September, 2009 has  per cent participation.

Training programme for Group D employees.

            The DI(HRD) vide his letter in F.No. No.HRD/CM/175/14/2008-09/340 29the July.2009addressed to all the CCITs has given the training module for non matriculate Group D employees.  Please take up this matter with the concerned CCITs and ensure that all non matriculate Group D are given the training and their grade pay enhanced to Rs. 1800/-.

            Onam is the State festival of Kerala.  The Festival commences on 23rd August,2009 and culminates on 2nd September, 2009.  This is also a social festival and is celebrated by one and all.  It had been the normal practice to draw and disburse the salary of the employees in the month in which the festival falls well prior to the commencement of the festival.  It has been represented to us that no order has been issued in this regard till date. 

 

            We shall be grateful if orders are issued to all Departments to disburse the salary for the month of August, 2009 by 22nd August, 2009 in respect of all officials working in the State of Kerala.

            In view of the ONAM festival, the Government have decided that the salary of all Central Government employees in the State of Kerala for the month of August,09 may be drawn and disbursed by the Central Government offices (including Defence, Posts and Telecommunications) on 28th August, 09

 

            The salary/wages so disbursed are to be treated as advance payments and will be subject to adjustment after the full month's salary/wages of each employee is determined.  The adjustment, if any, will be made without exception from the salary/wages as the case may be from the month of September, 2009.

 

            The concerned Ministries/Departments are requested to bring these instructions to the notice of their offices located in the State of Kerala for necessary action immediately.

Subject.            Payment of Second instalment of arrears on account of implementation of Sixth Central Pay Commission's recommendations.

 

            As communicated vide this Department's Resolution No.1/1/2008-IC dated 29th August, 2008, the Government had decided that the arrears on account of implementation of Sixth Central Pay Commission's recommendations  will be paid in cash in two instalments- first instalment of 40% during the years 2008-09 and the remaining 60% in the financial year 2009-10.  The first instalment has already been paid in 2008-09.  It has now been decided that the remaining 60% of arrears may now be paid to the concerned Government servants.

 

2.                  Further, as already stipulated vide this Department's O.M. No.1(2)/EV/2008 dated 17th August, 2009, in the case of post 01-01-2004 entrants into the Central Government, the second instalment of arrears may be released only after individual application forms for registration to the New Pension scheme have been obtained by the DDO/PAO from the concerned Government Servant.

3.                  As in the case of the first instalment of arrears, Government servants will be permitted to deposit their arrears in their GPF Accounts. Though not mandated, Government servants are encouraged to deposit their arrears in their GPF  Accounts.

CHARTER OF D E M A N D S

 

1.            Grant Grade pay of Rs. 4,600/- as per Government of India notification to Inspectors, Private Secretaries and Administrative officers and Rs.1,800/-to all Group D employees; Implement the clarification with respect to Grade Pay of Rs. 5,400/- to ITOs after 4 years w.e.f. 01/01/2006.

2.            Out of 1% incremental incentive:

               a. Reimburse Mobile phone charges to all employees in  the department

      b. Sanction Laptops to all Gazetted Officers including AO, PS/Sr.PS, on non-returnable basis.

3.            Deptl. Examination-2009 should be conducted accepting demands communicated vide  ITEFs letter dated 25th July, 2009 addressed to the  DGIT(Admn), New Delhi.

4.            Transfer DCIT/ACIT (who have completed 2 years cooling period and with spouse/medical/compassionate grounds, etc.) and revoke the transfer of officers, who are transferred before completing their tenure.

5.            Fill up all vacant posts  in gazetted and non-gazetted cadres and effect promotion to the cadre of ACIT/DCIT/Jt. CIT,  by giving one time relaxation. (Conduct DPC for ACIT  for RY 2009-10 and DCIT for RY as on 01/01/2009 and 01/01/2010).

6.            Grant correct seniority to DCIT on account of CAT decision in S.K. Shukla's case and Allot Civil List Code no. to all promotee ACsIT till R.Y. 2008-09

7.            Implement the order of the Supreme Court on Inter-se-Seniority in the case of Inspectors.

8.            BPR to be implemented only after reaching an agreement with the JCA and stop outsourcing  of Departmental  functions.

9.            Grant Desktop computers to all Group C employees.

10.          Dispose of all vigilance cases pending beyond one year.

11.          Stop vindictive actions on our members in the light of the recent issue in  MP charge.

Dear Sir,

            We solicit your kind reference to the discussion the representatives of this Federation had with you on 22nd July, 2009.  As per the decision taken at the said meeting we met the DG(Admn) to discuss the new pattern of examination on 23rd July, 2009.  We had detailed our objections to the New Rules with reasoning to the DG(Admn).  Except on the question of eligibility criterion, this Federation had not expressed any substantive reservation on the 2004 Rules which were promulgated by the Board on the recommendation of Shri Prabhu Committee.  We are not in a position to comprehend or appreciate as to why the Directorate wanted to substantially change the 2004 rules.  We had followed up our discussion with the DG(Admn) with a letter, a copy of which is enclosed for your ready reference.  None of the objections we had raised with the DG has been addressed.  This apart, he has given a peculiar definition for the term partially qualified.  According to the notification dated 05-08-2009 which is stated to have the Board's approval, partially qualified are those who have cleared two out of the 4 basic papers.  We do not understand as to why the Directorate has to take such a mean and untenable stand in these matters.  During the discussion, you had taken the stand that addressing the concerns of the candidates articulated by the ITEF is within the province of the  DG(Admn) and  the  Board  would  not  like  to intervene  in  the  matter,  whereas the DG intimates us that what is conveyed in the latest notification is with  the Board's approval.  In these circumstances, we are constrained to believe that the Board has no intention to address to the genuine concern and difficulties of the employees/candidates. 

                                   

The unreasonable stand of the Directorate in the matter of  negative marking and repetition of papers in Inspectors/Income-tax Officers examination and objective type questions etc remains unchanged.

 

Further, with regard to the Grade Pay of AOs/PSs & Inspectors, placing the Group D employees in higher grade pay of Rs. 1800 after the requisite training and in the matter of utilization of 1% incentive, no concrete action has been taken so far in spite of the repeated assurances by the Board. .

 

            Since our reasoned arguments and patient presentation of our grievances has been allowed to be bounced against the rock like unreasonable stand of the Directorate, we are constrained to advise our members to tread the path of agitation to make the Board and Directorate to see reason.  The members of the JCA will accordingly Walk Out on 18th August, 2009 from 12 Noon to press for the settlement of the following Charter of demands given below.  The JCA has also decided to hold demonstration as and when the Chairman/Member of the CBDT visit any Income-tax office in the country as part of the agitational programme.

Dear Comrades,

 

 

In our last Circular letter, we had intimated you of the details of the discussion the representatives of the Federation had with the Chairman and the DG(Admn) as also with the Secretary(Revenue).  The DI(IT) has now issued the fresh notification for the conduct of the examination had only been the motivating force behind the present notification.  The requirement of the candidates are not provided, even the existing ones withdrawn,  One is compelled to believe that neither the DG nor the Board is concerned with either the needs of the candidates nor with those of the Department in the changing scenario of its functioning.  The repetition of certain papers in all the three levels of examinations for no ostensible purpose had been the subject matter of discussion before the Prabhu Committee in 2002-03.  This and many other issues were considered by the Prabhu Committee and the product of the deliberations thereof was the 2004 examination rules.  Its operation was stayed only for one reason i.e., the Board's decision to change the eligibility criterion.  This matter was amicably resolved in 2008.  There had been therefore no substantive reason for the notification of a fresh wt of rules without causing  any consultation with this Federation.  The objective type of questions and the negative marking are features on which we had strong objections.

 

            Annexed hereto is a brief note on the objections raised by us, which has not been addressed by the Directorate.

 

            Neither on infrastructure fund nor on Grade Pay settlement has been brought about.  The Secretary (Revenue) despite supporting our genuine concern on Grade Pay has not been able to make the Department of Expenditure to see reason.

 

            The issue was brought before the members of the Secretariat immediately on the receipt of the fresh notification from the Directorate.  It is the considered view of the members of the Secretariat that the decision taken at the CWC on agitational programme should be immediately carried out.  Accordingly it has been decided to organize a walk out of 18th August, 2009 from 12.00 Noon onwards.  The letter we have addressed to Com.Rajesh Menon, Secretary General, ITGOA which is self explanatory is enclosed.  We hop to receive a positive response from him and the Central JCA will send in its communication as and when ITGOA decides upon joining in the programme. 

 

            Our letter to Chairman intimating of the programme will go after receipt of the intimation from ITGOA.  We request you to take necessary steps to implement this programme on 18th August, 2009 in right earnest jointly or if  need be independently. On walking out on 18th August hold demonstrations in front of all offices and the following telegram/savingram/fax sent to the Chairman, CBDT., North Block, Central Secretariat, New Delhi-110 001 and  to the  Secretary (Revenue), Govt. of India, Ministry of Finance, North Block, Central Secretariat, New Delhi -110 001.

Brief Note:

 

            We reproduce the submissions made for making change in the Rules.  None of the suggestions has been accepted by the DG(Admn) including the withdrawal of negative marks.

 

            The Examination on the old pattern was to be for all partially qualified candidates.  Partially qualified according to us means are those who have qualified in any of the four basic papers i.e., IT law I & II, Book-keeping, Other Taxes and Office Procedure.  The Directorate has decided that partially qualified means only those who have qualified in any two of the above mentioned four papers.  This is not acceptable to us.

 

Syllabus:

 

Our suggestion for omitting Hindu Law, Indian Succession Act, Information Technology Act and the Accountancy standard issued by the Institute of Chartered Accountants etc were on solid and substantive grounds.  The Directorate has only accepted partially our suggestions in this regard.

            Kindly refer to the discussions at the Central JCA meeting held on 18th July, 2009.  We had a detailed discussion with DG(Admn) on examination matters thereafter.  However, no satisfactory settlement could be brought about.  The DI(IT) has now issued notification for the conduct of the examination.

 

            We had consultation amongst our Secretariat members after the Notification was issued.  Our Secretariat is of the opinion that we should carry out our decision to organize walk out on 18th August, 12009 in the circumstance.  We are of the view that the said walk out must commence at 12.00 Noon for the rest of the day.  This is what I conveyed to you over phone.

 

            As it was decided that all programmes of actions are to be under the auspices of the JCA, I shall be grateful for your response in the matter as we are to convey this decision to the field formations immediately.  As and when you take decision in the matter, we may issue the circular letter on behalf of the JCA.
