Dear Comrade,

Kindly refer to our circular dated 15.9.2008 (posted at the Website) intimating you of the decisions taken at the last Sectt. meeting. Subsequently the Central JCA met and the decisions taken at the said meeting has also been communicated to you. We are to organize a mass deputation to all the Chief Commissioners of Income tax on 23rd .We reproduce the Central JCA Circular letter in this regard along with the Charter of Demands and request you to carry out the programmes of action as indicated therein. Today we have sent you the following SMS to all our Sectt. members and the CWC members reiterating the need to see the website and make arrangements for carrying out the programme.

Despite our best efforts, we regret to inform you that the Directorate in charge of Examination and the Board has taken an obstinate position in respect of relaxation of the Examination to be conducted for the year 2008 for no ostensible reason. The CWC will discuss the Board's attitude towards the employees in its meeting and will formulate its views. In the meantime, we are to inform you that on the basis of a petition filed by some employees before the Central Administrative Tribunal, Mumbai, the Tribunal has ordered that there is no reason in imposing an age restriction for taking up the Departmental Examination especially when the recruitment rules do not prescribe any such age restrictions.

Kindly ensure that the programme is carried out with full success.

Programme of Action:

  1. 23rd Sept. 2008: Mass Deputation to CCIT with memorandum,
  2. From Ist October, 2008:

a) No statistical reports except Parliamentary Question, to be prepared/ submitted.

b) No survey including TDS Survey/verification to be conducted/participated

c) Demonstration on the first visit of Board Chairman/Members at all places, as decided by the State JCA

Draft letter addressed to the Chairman to be signed and handed over to the Chief Commissioners by all concerned Circle Secretaries.

Sub: Settlement of Charter of Demands.

We submit the charter of demands as approved at the meeting on 14th September, 2008. These are the issues which are pending decision at the Board's level for quite a long time. These have been subjected to discussion on various occasions. On some of the issues, assurances were held out, but not honoured, reasons not made known to us.

This is being submitted through the respective Chief Commissioners of Income tax through a mass deputation for conveying to you the anguish and concern of the employees and officers and the growing discontent, which if not addressed immediately might affect the morale with consequential disruption of the smooth functioning of the Department.

Charter of Demands


1.Immediate implementation of the suggestions made by the JCA in respect of utilization of infrastructure fund.
2.RR of Gr. D. employees be amended as agreed upon. Notify the RR of Inspectors as Group B (Non-Gazetted)
3.Implement the 3 awards granted in 1998 by Board of arbitration
a) FR22(1) (a) (I) benefit to farrash Mali, Sweeper etc. on promotion as peon.
b) Special pay for Inspectors posted in Central circle & in Sr. AR(ITAT)’s office.
c) F.R 22(1)(a)(1) benefit for all inspectors on revision of the pay Scale in 1980.
4. Relax the eligibility criterion for Deptl. Exam. 2008 to allow all candidates who have crossed the age of 55 years and availed ten chances.
b) Reduce the pass marks for Inspectors Exam. to 40 and Ministerial Staff Exam. at 35, as has been done in the case of ITOs Examination..
5.Central Processing Units.
The agreement between the Board and Staff Unions on 23/07/2007 to be adhered to, both in letter and spirit.
6.Regularization of Daily rated workers who have put in ten years of service, as per DOPT order.
7.Filling up of huge vacant posts in the cadre of ACIT/DCIT/JCIT
Grant Ad-hoc promotion in respect of vacancies of R.Y. 2009-10 & 2010-11.
8.Create Leave Reserves, as existed up to the year 2001
9.Restructuring the cadre of Admn. Officers & Pvt. Secretaries in the ratio of 2:1
The matter is pending with the Board for more than 4 years. There is severe stagnation amongst the rank & file of AOs & PS. The re-structuring suggested is in line with the scheme as existing in CBEC i.e. Central Excise & Customs Dept.
11 Implement the interim order of the Hon’ble Supreme Court, in the case of all similarly placed Inspectors.
12 Implement all decisions arrived at in earlier meetings, including transfer back of Shri G.Gopalan to T.N.
13 Impart training to all employees and Officers on system related changes.
